This paper presents the conclusions of a forensic medical team in a dental negligence case involving both medical civil liability and civil proceedings.The defendant dentist removed the wrong tooth from a patient (second premolar instead of the upper right second molar). The insurance company paid out compensation on medical civil liability grounds and the patient sought further redress through civil proceedings for personal infringement and prosthetic treatment costs.The analysis of the act, apparently clear matter in the ground lay a medical problem, took surprising turn. Although dental negligence involving the unreliable conduct of medical records and commit his mistake of removing the wrong tooth, the key for medico-legal opinion was a medical records from another study, in which the patient is treated in several days earlier. From her records showed that there were absolute indications for extraction of two teeth. The opinion found that only the order of a physician turned tooth extraction, resulting in medical malpractice proved to be a neglience causing no injury for the patient. The discussion covers the importance of properly maintained medical records and medico-legal issues relevant to the case.
